What Am I Entitled to In Case of An Accident?

In California, if you are injured due to the negligence of another, you are entitled to monetary compensation.

Injury is not limited to physical injury and includes emotional injury as well. Also, in some circumstances those who watch you getting injured may have a claim for infliction of emotional distress.

In general, the negligent party is liable to you for the following:

  • Past medical expense
  • Future medical expenses and care
  • Past lost earnings
  • Future lost earnings capacity
  • Property damage
  • Pain and suffering

It is important to consult with a California attorney to determine what claims you can bring, as well as the extent of your damages. Bohloul Law, Apc., has extensive experience in representing those who have been injured in accident and will make sure you get the best possible settlement under the circumstances.

What Should I Do If I Am in A Car Accident?

Do not admit to fault: Make sure not to admit to fault. Many times, clients think they were at fault while they were not.

Exchange information: Leaving the scene of an accident without exchanging your driver’s license and insurance information is considered hit-and-run. Simply take photos of each other cards and call the police to the scene.

Take photos: When it is safe, take photos/videos from the scene. Ideally, your photos should clearly show where vehicles are positioned in relation to each other. Also, consider taking photos of the surrounding area and cross street. This is especially important if there is a camera in the vicinity of the accident and can help your attorney prove your case later down the road.

Police: If police arrived at the scene, try to find out which police department’s personnel have arrived so your attorney can obtain the police report later.

Medical treatment: After an accident, you have a duty to mitigate your damages. As part of that, you should immediately seek medical attention even if you do not feel any pain or discomfort. Most of the times, symptoms surface day(s) after the accident.

Call (310) 525-5116: Finally, it is very important to immediately contact a California personal injury attorney to start handling your case and shield you from insurance companies who will try calling you to get incriminating statement from you on a recorded line.

  • Tip: Insurance companies are NOT on your side, and they will do everything they can to refuse paying you for your damages. So, do not agree or sign anything and immediately hire your attorney to step in and talk on your behalf.

Why Do I Need a UM/UIM Insurance Coverage?

Uninsured Motorist coverage (“UM”) protects you if you are hit by a driver who does not have insurance coverage to pay for your damages.

Underinsured Motorist coverage (“UIM”) protects you if you are hit by a driver who does not have enough insurance coverage to cover all your damages. For example, if the driver who hit you has $30,000 in coverage and your damages are $50,000, then, if and when you collect the $30,000 from that driver’s insurance company, you can file a claim with your own insurance for the remaining $20,000.

  • Tip: Some insurance companies do not offer UM/UIM coverage unless you ask them to add that to your insurance policy. This is because it would increase their burden to pay you when you are injured, and because the cost of obtaining such coverage is usually very small in comparison to the main policy. So, you should check your policy today and if you do not see a UM/UIM coverage, you should pick up the phone and ask your insurance company to add both coverages to your policy.

What Should I Do If I Am Injured On Someone Else’s Property?

Sometimes, people get injured while they are on another person’s property.

For example, you may have been injured because you slipped and fell on a slippery surface or a liquid in a grocery store, tripped and fell on a raised sidewalk panel, an item fell on you or your head while you were in a department store, or fell on a stair that was old and needed repair. Don’t forget that a dog bite could also allow you to demand compensation.

No matter the situation, the property owner or the person who is in possession or control of the property may be liable to you. But you should first prove your case. To do that, you want to make sure to preserve the evidence, make a report and immediately contact Bohloul Law, Apc., at (310) 525- 5116.

Make a Report: If you are injured in a store because an item has fallen on you, because you slipped and fell etc., the first thing you should do is to ask for the manager to make a Report. Most sophisticated stores have special forms for that, but even if they don’t you can still make a written report to the manager. Make sure to get a copy of the Report (even a photo works) and time and date it.

Take photos: Evidence is the key to success, so take photos/videos from the scene and of items involved. Ideally, your photos should clearly show where the incident happened and its vicinity. Also, consider taking photos of the surrounding area. This is especially important if there is a camera in the vicinity of the area where you got injured and can help your attorney prove your case later down the road.

Keep your footwear and clothes: Consider keeping your footwear and what you were wearing at the time of the incident. Sometimes the liquid you slipped on leaves a mark on your clothes that can help you prove the surface was wet. Sometimes the footwear can prove the surface on which you fell was unreasonably unsafe.

Medical treatment: After an incident, you have a duty to mitigate your damages. As part of that, you should immediately seek medical attention even if you do not feel any pain or discomfort. Most of the times, symptoms surface day(s) after the accident.
